What Is a Spouse Open Work Permit?
An SOWP is an open work permit. It may allow an eligible spouse or common-law partner to work in Canada without being tied to one specific employer and, in most cases, without a job offer or Labour Market Impact Assessment (LMIA).
Eligibility depends on both the principal applicant — the person studying or working in Canada — and the spouse's own situation. IRCC changed the rules for spouses of international students and foreign workers on January 21, 2025, so older guidance may no longer apply. The main categories are below. Belonging to a category does not mean every spouse automatically qualifies.
Spouse or Common-Law Partner of an Eligible International Student
Since January 21, 2025, open work permit eligibility for spouses of students is limited. It generally depends on the student's current program — for example, certain master's programs of a minimum length, doctoral programs, and specific professional degree programs — and on the student holding a valid study permit.
Not every international student's spouse qualifies. The student's program and institution must be checked against current IRCC rules.
Spouse or Common-Law Partner of an Eligible Foreign Worker
For spouses of workers, eligibility generally depends on the principal applicant's work permit, occupation and TEER category, and on how much time remains on the principal's permit when the spouse applies. Certain TEER 2 and 3 occupations in designated sectors may also qualify.
Being married to a foreign worker does not by itself make a spouse eligible.
Other Eligible Situations
Other open work permit categories and public policies may apply — for example, to some spouses of permanent residence applicants or of people in certain immigration programs. Eligibility depends on the specific pathway and its current requirements.

If you are already in Canada as a visitor, student or worker, you may be able to apply for an SOWP or extend your status from inside Canada when you meet the category requirements. Applying for an SOWP From Outside Canada
Eligible spouses outside Canada can apply for a work permit before travelling, often alongside the principal applicant. Biometrics, a medical exam or a visitor visa may also be required. Approval is not guaranteed.

Can I extend my Spouse Open Work Permit?

You may be able to extend it if the principal applicant's status is extended and you still meet the current eligibility rules. Extensions are assessed under the rules in force when you apply, so an earlier approval does not guarantee a new one.
An open work permit generally lets you work for most employers in Canada, but some employers and occupations are excluded and your permit may carry conditions, such as a medical exam requirement for certain jobs. Always check the conditions printed on your permit.
